Rent arrears at the Landlord and Tenant Board.

Ontario residential tenancies are governed by the Residential Tenancies Act, 2006. Self-help eviction is prohibited; relief comes through the correct Board form, correctly served.

What to do now

  1. Do not change the locks, remove belongings or shut off services.
  2. Confirm the tenancy is governed by the RTA and identify the correct form.
  3. Prepare an accurate arrears ledger from the start of the tenancy.
  4. Serve the required notice properly — service defects are the most common reason applications fail.
  5. Get advice before the hearing about evidence and the possibility of a payment plan order.

What to bring to your lawyer

  • The lease and any renewals
  • Rent ledger and proof of payments received
  • Any notices already served, with proof of service
  • Communications with the tenant
