A regulator has written to your business.

Regulatory correspondence usually carries a response deadline and often an implied invitation to make admissions. What you write back becomes part of the record.

!
Time-sensitive
A deadline may already be running.

Some legal claims are subject to strict limitation periods. If you believe you may have a claim, do not delay obtaining legal advice.

What to do now

  1. Diarise the response deadline stated in the notice.
  2. Identify precisely which entity and which regulator is involved.
  3. Do not submit records or explanations before counsel reviews what is being requested.
  4. Preserve the documents referenced in the notice.
  5. Obtain advice on scope, privilege and the response strategy.

What to bring to your lawyer

  • The notice and the envelope or email it arrived in
  • Corporate records for the entity named
  • Any prior correspondence with the regulator
  • Internal records the notice refers to
