You were terminated and handed a package. Before you sign.

A termination package is an offer, not a statement of your entitlement. Statutory minimums under the Employment Standards Act, 2000 are a floor; common-law reasonable notice is frequently higher.

Time-sensitive
A deadline may already be running.

Some legal claims are subject to strict limitation periods. If you believe you may have a claim, do not delay obtaining legal advice.

What to do now

  1. Do not sign the release on the spot, even if a deadline is stated in the letter.
  2. Ask for the offer in writing, including how the amounts were calculated.
  3. Collect your employment agreement, offer letter and any amendments.
  4. Continue to look for comparable work — mitigation matters.
  5. Have the package reviewed before the stated deadline expires.

What to bring to your lawyer

  • Employment agreement and any amendments
  • Termination letter and severance offer
  • Recent pay stubs, T4s, bonus and commission records
  • Benefits and pension information
  • Performance reviews and relevant emails
