Transportation litigation

Transportation disputes rarely stay in one lane. A single incident can generate a commercial claim, a coverage dispute, a regulatory proceeding and an employment claim, and the positions taken in one can be used in the others.

You may need a lawyer if…

  • You have been sued by a shipper, broker, driver or another carrier
  • You need to sue to recover freight charges or equipment
  • An insurer has denied coverage or is defending under a reservation of rights
  • You are facing a regulatory proceeding alongside a civil claim
  • Equipment financing or lease obligations are in dispute
  • A commercial relationship has ended and the accounts are contested

How we can help

  • Prosecution and defence of commercial transportation claims
  • Coverage disputes and claims against insurers
  • Injunctions and preservation of equipment
  • Coordination of civil, regulatory and employment exposure
  • Appeals
  • Settlement negotiation and mediation

What happens next

  1. We map every proceeding the incident could generate before responding to any of them.
  2. We identify limitation periods and notice obligations immediately.
  3. We secure the documents and data that will decide the case.
  4. We advance or defend the claim in the correct forum.
  5. We keep the regulatory and insurance positions consistent with the civil one.

What to bring

  • The claim, demand or notice you received
  • The contracts and rate confirmations in issue
  • Trip, dispatch and telematics records
  • Insurance policies and adjuster correspondence
  • Any related regulatory correspondence

Questions clients commonly ask

How long does a commercial transportation dispute take?

It depends on the forum and the complexity. Small Claims Court matters resolve faster than Superior Court actions, and matters that settle at mediation resolve faster than those that go to trial.

Should the insurer be involved?

If any policy might respond, notice should be considered immediately. Late notice is a common basis for coverage disputes and is avoidable.

Can a regulatory finding be used in a civil case?

Findings and admissions made in one proceeding can have consequences in another, which is why the positions need to be coordinated from the start.
